These Terms and Conditions apply to vehicle rentals carried out by ACT AND DRIVE P.C. , (hereinafter “ACT & DRIVE”) based in Thessaloniki (Fragon 1, Tel. +30 2311218248). Every reservation request you make through our website adrentacar.gr, or by telephone reservation or by e-mail reservation, implies your acceptance of these terms and conditions. These terms also include the terms of the Rental contract to be signed upon delivery of the vehicle.
You can submit a request to reserve one of our vehicles through the reservation form on our website adrentacar.gr, by sending an email to info@adrentacar.gr or by phone at the contact numbers listed at the bottom of our website.
Your request is a proposal to us to enter into a Rental agreement with you. In order to draw up the contract, we will have to check the availability of the vehicle you want and confirm the acceptance of your reservation by e-mail. When you complete and submit our website booking form, you will receive an automated message that we have received your request. However, this does not imply its acceptance by ACT & DRIVE, for which an availability check and a new message accepting your proposal is required.
3.1. By signing the agreement, as a Renter, you declare that, after carefully checking the vehicle and finding that it is in excellent condition, to your absolute satisfaction and suitable for the use and purpose for which you are renting it, you have received the vehicle unreservedly. You also understand that at the time of return and delivery of the vehicle to ACT & DRIVE you will sign a relevant proof document for any existing damages to the vehicle.
3.2. At the time of expiry or in any way of termination of the agreement, as the Renter you are obliged to return the vehicle without delay to the ACT & DRIVE store, or alternatively to the agreed delivery point.
3.3. ACT & DRIVE is not responsible for the loss or damage of any property of you or a third party located in or on the rental vehicle.
ACT & DRIVE rents the vehicle to you as a Renter for the period of time expressly defined in the rent agreement, which cannot be less than one (1) day. If you wish to keep the vehicle for a longer period of time than agreed, you must contact the ACT & DRIVE store from which you collected the vehicle in writing and sign a new rental contract. If you do not return the vehicle at the agreed place and time, you are in breach of the terms of the agreement and are obliged to pay compensation to ACT & DRIVE for each additional day the vehicle is withheld. Furthermore, after the agreed return time of the vehicle has expired, ACT & DRIVE has the right to remove and take possession of the vehicle, without your consent, at anytime, anywhere and in any way, even at your expense.
5.1. As a Renter, you undertake to pay ACT & DRIVE on time, and in any case at the end of the rental: i) the agreed rent, ii) the agreed special daily charge for the optional exemption-coverage of your liability, if this has been agreed iii) the mileage charge, according to the kilometers traveled, iv) any additional charge from the provisions or from those that may arise during the return and delivery of the vehicle to ACT & DRIVE and v) any tax charges and fees corresponding to the above.
5.2. As a Renter, you also undertake the following obligations:
5.2.1. Keep the vehicle in excellent condition, including but not limited to using the right type of fuel, checking its mechanical condition, oil and water levels, tires, etc., using it properly, according to its instructions manufacturer and ACT & DRIVE, and immediately inform ACT & DRIVE of any defect or malfunction or mechanical indication that appears. It is not permitted for any third party to conduct work and/or repairs on the vehicle without the prior specific written consent of ACT & DRIVE.
5.2.2. Park the vehicle in a guarded area that meets all safety rules to prevent theft, damage or physical wear and tear. In particular, when the vehicle is not in use, it must remain locked and the keys will always be in your possession.
5.2.3. To use the vehicle exclusively and only for the purpose specified herein and beyond that not to lend, Rental or in any other way make available or grant the use of it to third parties and not to leave the Greek border with the vehicle, without the prior consent of written consent of ACT & DRIVE.
5.2.4. Do not use the vehicle: a) for illegal purposes or contrary to the applicable national and European legislation, b) in violation of the provisions of the Road Traffic Code , c) for paid transportation, occasionally or by profession, persons or objects/goods, especially explosives, d) in speed races or motor sports, e) for driving learning purposes, f) for towing or pushing other vehicles and g) in off road routes. Furthermore, the use of the vehicle by anyone under the influence of alcohol, drugs, hallucinogens, barbiturates or any other substance that affects driving ability and senses is strictly prohibited.
5.2.5. In the event of an accident, as a Renter you are obliged to: a) inform ACT & DRIVE and the competent authorities without delay b) gather the information of eyewitnesses, c) draw up a sketch of the accident conditions and d) complete with every possible detail, within forty-eight (48) hours, the relevant accident statement of the insurance company cooperating with ACT & DRIVE.
5.2.6. In case of breach of your above obligations, you are fully responsible for any fines, administrative penalties and court costs imposed during the Rental and in general for any damage of ACT & DRIVE, positive or consequential, without excluding other compensation, and regardless if you have accepted any optional coverage of your liability.
5.2.7. Smoking inside the car is prohibited during the rental period, any damages that will be caused the lessee is fully responsible for them
In order to request to rent one of our vehicles, the driver of the vehicle must be at least 23 years old for all categories of small vehicles, while for large and luxury vehicles, the driver must be at least 25 years old.
The driver must have a Greek or European Union or international driver's license with a date of issue at least one year before.
At the start of the rental the driver and any second driver must bring their driver's license and passport or ID with them.
If the driver does not bring his driver's license, passport or identity card, or if any of them are invalid or not genuine, the rental cannot be carried out.
The driver's license, passport or identity card must be presented in original. Faxes or photocopies are not accepted.
ACT & DRIVE will keep a photocopy of the above documents, in accordance with current legislation.
You can pay off the vehicle rent in one of the following ways:
A) by cash payment.
B) by bank payment through the payment provider viva wallet. If you choose this payment method, a message with a unique link will be sent to your e-mail account, where you can make your payment through the secure environment of Viva Wallet.
C) by deposit to the bank account of ACT & DRIVE.
D) by MasterCard & Visa credit card.
10.1 Charge per 24 hours
Car rental is calculated per 24 hours. Any additional delay will be charged an additional day.
10.2 Infant and child seats
Infant seats, child seats and booster seats are available at an extra charge.
10.3 Loss of Key
The Renter will be charged the cost of a key replacement if it is lost during the tenancy. The exact cost of the replacement depends on the type of vehicle.
10.4 Vehicle Cleaning
In the event that the car requires a special cleaning process (i.e., to eliminate odors, animal fouling, fluid leakage, etc.) after its return a charge will be made for the cleaning.
In order to complete and reserve the Rental, an advance payment of 30% of the Rent is required, corresponding to the entire agreed duration of the Rental.
In order to guarantee the faithful fulfilment of the terms of the contract and any damage or destruction of the vehicle, it is required to declare a debit/credit card even if you pay the rent in cash. When concluding the Rental, your card will be charged with the guarantee amount that corresponds to the type and category of the car and its availability.
The guarantee is fully refunded in the same way (re-credit to your credit card) when the vehicle is returned and there is no partial or total damage. In the event that the vehicle is not returned on the agreed date, or is returned with partial or total damage due to your fault, the guarantee is not returned, but forfeited as a penalty clause for the unproven damage of ACT & DRIVE. It is not possible to offset due rents with the amount of the guarantee.
A change to a reservation can be made after a telephone call and involves a recalculation of the price, according to the availability of vehicles, at the prices valid at that time.
In case of cancellation of a booking 20 days or less before the agreed start of the rental, the 30% deposit is non-refundable.
In case of returning the car earlier than the date of the reservation, there will be no refund.
The replacement of a car due to mechanical damage or due to an accident can be done within 48 hours in the period from 15/09 to 14/06 and within 72 hours in the period from 15/06 to 14/09.
ACT & DRIVE car renters are insured with the following program which includes:
ACT & DRIVE undertakes the insurance coverage of the rented vehicles, within the framework defined by the law, from the delivery of the vehicle and for the entire duration of the Rental for the insurance coverages required by law through an Insurance Company, with coverage civil liability to third parties for bodily injuries up to the amount of 1,220,000 euros and civil liability coverage to third parties for material damages up to the amount of 1,220,000 euros.
ACT & DRIVE additionally undertakes the following additional coverages:
a. Coverage of the same damages with a liability waiver borne by the Renter, according to the amount corresponding to each type of vehicle.
b. Total theft insurance
c. coverage of partial theft of parts or components of the vehicle, which are firmly attached to it and are necessary for its movement and operation,
d. coverage of own losses in case of theft with exemption from liability borne by the Renter as provided for each vehicle
e. Covering fire and covering fire from terrorist acts,
f. Coverage of natural phenomena
g. Crystal breakage coverage
h. Coverage of material damage from an uninsured third-party vehicle
i. Coverage for personal accident of the driver up to the amount of EURO 15,000 (fifteen thousand) and
j. 24-hour roadside assistance coverage.
Insurance Contract Exemption Amount
The amount of the insurance coverage exemption for own damages is determined from €1000 to €1500 per vehicle depending on its category. The above amount is borne by the renter of the vehicle, in case of damage to the vehicle due to his fault.
Personal accident cover for the driver
The insurance coverage for accidental death is up to €15,000 and for fire and theft up to €3,000.
Exclusion of insurance coverages
No insurance contract is valid in the following cases:
• For any incident in which it is found that the driver was under the influence of alcohol or drugs.
• For accidents caused by a driver not stated in the rental contract.
Delivery outside the ACT & DRIVE office but within the city limits, free of charge.
Delivery beyond the city limits is subject to an additional charge of €1.25/km. for small and medium vehicle categories and €1.50/km. for large and luxury vehicle categories.
The delivery to a different station from the one of the pick-up, entails an additional charge to the renter depending on the kilometer distance between the two stations, with €1.50 / Km.
Delivery to the airport is free.
Delivery/pickup outside opening hours incurs a charge of €20 to the tenant.
(Office hours: Monday-Friday: 09:00 - 21:00, Saturday: 10:00 - 15:00).
ACT & DRIVE's written approval is required to transport the car by ship.
The rental of the ACT & DRIVE Vehicle outside the borders of Greece is not allowed.
Fines and any other consequences of violations of the law that occurred during the rental are entirely and exclusively borne by the Renter even if they are confirmed in the name of ACT & DRIVE or its representatives.
ACT & DRIVE, in the context of the Rental contract you enter into, is Controller of your personal data, as it collects and processes your personal data as a Renter or driver of the Rented vehicle that is necessary for the execution of the Rental contract, (e.g. name, contact information, address, driver's license, credit card information for rent payment, etc.), for its compliance with its legal obligations (such as your tax identification number for the issuance of the tax document that is required by law), as well as the fulfillment of its legal interests (e.g. violation data, accident information, statements and other data in the event of an accident to secure its legal claims, geo-location data to find the vehicle in the case of theft, etc.).
The above personal data is kept by ACT & DRIVE for as long as is necessary to fulfill each purpose of its processing. Recipients of the data are in principle professionals with whom ACT & DRIVE may cooperate in the context of the Rental contract or its operational needs, such as indicatively the insurance company that provides the insurance contract, tax and legal advisors, IT support providers , e-mail providers, etc., who are contractually bound in any case to process these data exclusively for the purposes for which they were transmitted, respecting the confidentiality and data security obligations imposed on them by law. ACT & DRIVE should transmit your data to the competent authorities, when this is provided for by law, or a relevant request is submitted competently. This can happen e.g. in case of confirmation of a traffic violation or a traffic accident.
As a data subject as a Renter or driver, you have the right to access the data concerning you, the right to request the correction of inaccurate data, the right to erasure, the right to restrict processing, the right to data portability and the right to object to the processing of personal data. You have the right to file a complaint with the Personal Data Protection Authority if you believe that your data is being processed unlawfully. The Authority recommends that you first contact us to submit any complaint or request. You can do it for free, by emailing info@adrentacar.gr. We will make every effort to satisfy your request. In case you are not satisfied with our answer, you can submit your complaint to the Authority (1-3 Kifisias St., 115 23 Athens, tel. 210-6475600, www.dpa.gr, email: complaints @dpa.gr). The terms of the Rental apply even in case of replacement of the original vehicle, or extension of the Rental. Any modification of the terms of the agreement is void unless agreed in writing. ACT & DRIVE has the right to terminate the Rental in case of breach of its terms, all of which are agreed to be essential, as well as immediate repossession of the vehicle. It also reserves the right to claim your debts arising from the rental agreement.
The terms herein are governed by Greek law. The courts of Thessaloniki are competent for resolving any dispute arising from the interpretation and/or application of the agreement.
